PERSONAL PRACTICE SUMMARY

Jaime Ubilla handles local and international projects with an emphasis on green and clean technology projects as well as on ecosystems conservation and environmental related projects.

He has advised for many years new clean technology projects as well as various sustainable projects that connect Asia and Latin America.

He has also provided services for many years to various international conservation NGOs and social business entrepreneurs, think tanks, business associations and chambers of commerce.

He is the founder and director of the Conservation Law Center of Chile and he originally proposed the creation in Chile – as well as the specific legal design- of the ‘conservation property right’ of Law 20.930.

He cooperates with several universities and research centers in Chile and internationally, and his academic research is centered in legal theory, social theory and private law, including his theory of legal forms and reflexive legal forms, a new approach to reflexive law (Soziale Systeme 29, 2024). Conservation lawyer since the 1990s: over more than three decades he has been part of the external legal teams of Douglas Tompkins and of The Nature Conservancy for the Valdivian Coastal Reserve, and today works with the team of Intrinsic Exchange Group (IEG). He is a permanent participant in Stanford University’s Natural Capital Alliance and the Capitals Coalition.

Publications and academic recognition

Jaime Ubilla is the original proposer of the conservation right (2003) and drafted the final articles of Law No. 20.930 through amendments submitted to the Chilean Senate committees, as Executive Director of the Centro de Derecho de Conservación (2014, 2015 and 2016). Central elements of his drafting include the definition of the conservation right (art. 2) —with its two essential elements: the faculty to conserve and its object, the environmental patrimony of a property and its attributes or functions— and the qualification of those attributes or functions as immovable property (art. 3). His work is cited by universities and publishers in Chile and abroad.
