UB Conservación – Conservation law

UB Conservación

The conservation law and natural capital practice of Ubilla y Cía., in cooperation with the Fundación Centro de Derecho de Conservación.

Dr. Jaime Ubilla in front of the Paine massif
Led by Dr. Jaime Ubilla, original proposer (2003) and drafter of the final articles —through amendments in the Senate— that shaped Law No. 20.930 on the Conservation Right (derecho real de conservación). PhD (University of Edinburgh) and professor at the UC Davis School of Law. A conservation lawyer since the 1990s: over more than three decades he has been part of the outside counsel teams of Douglas Tompkins and of The Nature Conservancy for the Valdivian Coastal Reserve, and today works with the Intrinsic Exchange Group (IEG) team. He is a permanent participant in Stanford University’s Natural Capital Alliance and in the Capitals Coalition.#conservationlawyer #conservationright #derechorealdeconservacion

What we do

1

Conservation rights

Design, drafting and creation of conservation rights under Law No. 20.930, case by case.

2

Holder entity

We structure the entity that holds the right —for-profit or non-profit— together with the owner, the community or the investors.

3

Contracts and management plans

Conservation contracts, management plans, governance and long-term monitoring mechanisms.

4

Natural capital

Natural capital assets and their accounting under international accounting standards, together with Natural Capital DMB.

5

Audit · CR Compliance Seal

External and independent verification of compliance with Law No. 20.930, carried out by the Fundación Centro de Derecho de Conservación, with ecosystem and natural capital assessments by Natural Capital DMB.

6

Companies, cities and territory

Real estate projects, urban green areas, environmental offsets and sustainable productive projects.

No custodians or guarantors needed

Law No. 20.930 provides for a holder of the right, who may be the owner or an entity the owner trusts. Compliance is assured through independent external audits: the auditor cannot be the holder of what it audits. Read more

Who we work for

  • Landowners , rural and urban, who want to protect their land over the long term.
  • Companies that need offsets, measures for environmental assessment or verifiable sustainability targets.
  • Developers of real estate projects, subdivisions and parcelling schemes that include conservation areas.
  • Foundations, communities and municipalities that manage natural spaces.
  • Investors , Chilean and foreign, interested in natural capital assets.

Why Ubilla y Cía.

Dr. Jaime Ubilla is the original proposer of the conservation right (2003) and drafted the final articles of Law No. 20.930 through amendments submitted to the Chilean Senate committees, as Executive Director of the Centro de Derecho de Conservación (2014, 2015 and 2016). Central elements of his drafting include the definition of the conservation right (art. 2) —with its two essential elements: the faculty to conserve and its object, the environmental patrimony of a property and its attributes or functions— and the qualification of those attributes or functions as immovable property (art. 3). His doctoral research at the University of Edinburgh and his academic publications on the subject support a practice that combines legal theory, legislative experience and advice on concrete projects.

We are working on several other projects, and our experience is that each case required tailor-made solutions. The Centro de Derecho de Conservación and Ubilla & Cía. are keen to provide as much pro bono support as possible for the proper implementation of this new reflexive conservation paradigm.
